Terms and Conditions

General information

Climbing Liguria, represented by Constantin Pade, provides its services exclusively on the basis of the following Terms and Conditions. These apply to all legal relationships between Climbing Liguria and participants, even if they are not expressly referred to in individual cases.

1. Participation

Participation is open to anyone who meets the requirements stated in the course description. Minors require written consent from a parent or legal guardian.
You are responsible for ensuring that your state of health and fitness is suitable for participation.

2. Registration and Conclusion of Contract

Registration is made via www.climbingliguria.com or by email. By registering, you submit a binding offer to conclude a participation contract. The contract is concluded only upon receipt of our written booking confirmation.
Note: There is no statutory right of withdrawal, as these are leisure services provided on a fixed date (Section 312g (2) No. 9 German Civil Code / EU Directive).

3. Payment & Prices

Upon booking confirmation, you will receive an invoice for a deposit of €50. This is payable within 10 days, or immediately in the case of short-notice bookings before the course start date. The remaining balance will be invoiced after the course has taken place. In the event of late payment, default interest and reminder fees may be charged. The prices stated at the time of booking apply. Discounted prices for participants up to and including 25 years of age are based on the participant’s age on the first day of the course.

4. Minimum Number of Participants

If the minimum number of participants stated in the course description is not reached at least 14 days before the course begins, Climbing Liguria may withdraw from the contract. Any payments already made will be refunded immediately. There is no entitlement to reimbursement of additional expenses (e.g. travel or accommodation costs).

5. Cancellation by the Participant

You may withdraw from the contract at any time before the course begins. Cancellation must be made in writing by email. The following cancellation fees apply:
  • Up to 30 days before course start: €50 processing fee per person
  • 29 to 14 days before course start: 30% of the course fee
  • 13 to 1 day before course start: 60% of the course fee
  • On the day of the course or in case of no-show: 90% of the course fee

6. Transfer of Booking

If you are unable to attend, you may transfer your booking to a substitute participant, provided they meet the participation requirements. Notification must be given by email within a reasonable period before the course begins.

7. Insurance

The course instructor holds the legally required public liability insurance. You are responsible for ensuring adequate personal insurance cover (e.g. accident, health, and travel cancellation insurance).

8. Changes to Services

Changes or deviations to individual services that become necessary after the contract has been concluded (e.g. due to weather conditions) and do not significantly affect the overall character of the course are permitted.

9. Unused Services

If you do not make use of individual services properly offered after the course has begun, there is no entitlement to a refund.

10. Cancellation by Climbing Liguria

If a course has to be cancelled due to extraordinary and unforeseeable events (e.g. governmental orders, natural disasters, strikes, war, epidemics, or extreme weather conditions), there is no entitlement to course delivery. Course fees already paid will be refunded on a pro-rata basis according to services already provided.

11. Complaints

If services are not provided in accordance with the contract, you must notify the course instructor immediately and request remedial action. Failure to do so will result in the loss of any right to a reduction, unless notification would have been unreasonable.

12. Obligations of Participants

You are obliged to meet the requirements stated in the course description and to provide truthful information. You are responsible for the proper functioning of your own equipment. Any damage to rental equipment beyond normal wear and tear must be compensated.
The course instructor has the right to exclude participants who are inadequately equipped or clearly unable to meet the course requirements. In such cases, there is no entitlement to a refund. During the course, you must follow the instructor’s instructions. Failure to do so will result in exclusion from the course without refund.

13. Liability

Climbing Liguria is liable within the scope of its existing public liability insurance for personal injury, property damage, and financial loss caused by gross negligence or intent.
For damage resulting from injury to life, body, or health, Climbing Liguria is also liable in cases of simple negligence. For other damage caused by simple negligence, Climbing Liguria is liable only in the event of a breach of an essential contractual obligation (cardinal obligation); in such cases, liability is limited to foreseeable, typical contractual damage.
Participation is always at your own risk. You acknowledge that alpine risks (e.g. risk of falling, rockfall, sudden weather changes) cannot be completely ruled out, despite the greatest care.

14. Image Material

Photos or videos may be taken during the courses in which you may be recognisable. If you do not wish such material to be published (e.g. for marketing purposes), you must explicitly inform us. This can be done at the time of booking or before the course begins.

15. Data Protection

Your personal data will be used exclusively for processing registration and organising the course. Data will only be passed on to third parties where necessary for the execution of the course (e.g. to the course instructor). Further information can be found in our Privacy Policy.

16. Applicable Law and Jurisdiction

The law of the country in which Climbing Liguria, represented by Constantin Pade, is based shall apply. For claims brought by Climbing Liguria, the place of jurisdiction is the company’s registered office. For claims brought by participants, the place of jurisdiction is their place of residence, unless mandatory law provides otherwise.
